The Trading Academy Terms
and Conditions
These Terms and Conditions ("Terms”) constitute a legally binding contract between The Trading Cafe Limited ("The Trading Academy") and the onboarded student ("Student"). By accessing and utilizing the services provided by The Trading Academy, the Student agrees to be bound by these Terms. Please read these Terms carefully before proceeding with the program.
1. Access and Usage
1.1 The Trading Academy provides access to its education platform to individuals who are at least 18 years old and have paid their tuition fees by the agreed-upon deadline.
1.2 It is the responsibility of the Student to access and use The Trading Academy's platform and services in accordance with these Terms.
2. Student Responsibilities
2.1 The students are encouraged to actively participate in the courses, submit questions, and engage with the community. However, participation is voluntary and not obligatory.
2.2 Students are required to adhere to the community guidelines when interacting within The Trading Academy's community.
3. Course Content and Modifications
3.1 The Trading Academy agrees to provide the Student with access to their Legacy Plan, a structured 3-phase program designed to teach trading skills and strategies.
3.2 The Trading Academy reserves the right to modify or update course content, curriculum, or materials as needed.
3.3 The Trading Academy will provide notice to the Student about any significant changes to the course content or curriculum.
4. Payment
4.1 The Student agrees to pay The Trading Academy Tuition Fees for their chosen education option.
4.2 The course fees will be waived as a bonus for joining the next cohort.
5. Guarantees
5.1 Upon completion of the entire program and all projects, and subject to the conditions outlined below, The Trading Academy offers the Student a choice of guarantees.
5.2 The Student may choose one of the following guarantees:
a. Full refund of investment and an additional $10,000 compensation if the Student's trading performance does not improve.
b. Full refund of investment and payment of the Student's hourly rate for time spent on the program.
c. Full refund of investment and coverage of any losses incurred in the Student's trading account.
5.3 Conditions for Guarantee Eligibility
a. The Student must complete the entire program, including all phases and assignments.
b. The Student must attend live sessions, or watch replays, of at least 80% of the live sessions throughout the program.
c. The Student must submit all required assignments and projects within the specified deadlines.
d. The Student can only claim the guarantee after the chosen program period (12 months) has ended.
5.4 Time Limit for Claiming Guarantees
a. The Student must claim the guarantee within 30 days of completing the program. Any guarantee claims made after this period will not be considered.
5.5 Documentation Requirements for Guarantee Claims
a. In the event that the Student wishes to claim a guarantee, they must provide the following documentation to The Trading Academy:
i. Proof of program completion, including all projects, such as a certificate or completion email.
ii. Trading account statements demonstrating the Student's trading performance during and after the program.
iii. Any additional documentation requested by The Trading Academy to substantiate the Student's claim.
6. Refund Policy
6.1 All sales are final. A refund will only be granted under the conditions specified in the Guarantees section of these Terms.
7. Termination
7.1 Either party may terminate this Agreement upon written notice if the other party breaches any material term or condition of this Agreement and fails to cure such breach within thirty (30) days after receipt of written notice.
8. Governing Law
8.1 This Agreement shall be governed by and construed in accordance with the laws of Hong Kong.
9. Agreement Acceptance
By accessing and utilizing the services provided by The Trading Academy, the Student acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. The Student further acknowledges that these Terms and Conditions constitute the entire agreement between the Student and The Trading Academy.
